Opinion of the Court

In re: Claude Watts, applying for writ of habeas corpus.

Writ denied. Based upon the information furnished this Court by the District Attorney to the effect that the minutes of court show all relator’s convictions in the Parish of Iberville to have been with benefit of counsel, the result reached by the district court is correct.

Dissenting Opinion

DIXON, J.,

dissents. The trial judge erred in denying an evidentiary hearing to determine whether uncounselled convictions were used to impeach applicant on his trial. Under new provisions and rules, the hearing could have been held without returning the applicant from Angola to Iberville Parish. The factual determination should not have been left to this court.
