SANDERS, C. J.,

dissents from the granting of the writ as to Starr, being of the opinion that the court minutes adequately show a waiver of counsel.

Opinion of the Court

In re: Thomas 0. West, Eldred A. Saxton and Paul K. Starr applying for writs of certiorari, mandamus and prohibition.

Writ application of petitioners West and Saxton are denied. No merit in their applications.

Application of petitioner Paul K. Starr is granted; a contradictory hearing is ordered to determine whether defendant’s rights as explained to him at time of underlying DWI conviction, and as to which court minutes indicate waiver, included the right to have an attorney represent him.
