Dissenting Opinion

DIXON, J.,

dissents. There has been no evidentiary hearing to determine whether it is true that state-appointed defense lawyer promised that applicant would receive only two years if he pleaded guilty.

CALOGERO, J., dissents from writ refusal. Applicant is entitled to an evidentiary hearing.
