Concurring Opinion

TATE, J.,

concurs. The initial delay within which to file this application expired on September 1st. An extension was not granted until September 28th. Although I disagree with the interpretation we have held that the trial court does not have jurisdiction to grant an extension after one initial or properly extended delay has expired.
