Opinion of the Court

In re: Michael Fonseca applying for Cer-tiorari, or writ of review, to the Court of Appeal, First Circuit, Parish of St. Mary. 347 So.2d 1246.

Granted, and remanded to the district court to reconsider its forfeiture judgment in the light of State v. 1971 Green GMC Van and State v. One 1973 Grand Prix Pontiac, docket No. 59,635, decided September 19, 1977.

SUMMERS, J.,

dissents. Because I do not agree with the decisions of this Court referred to in the reasons assigned by the majority, and in my view the decision of the trial and appellate courts was correct, I would deny this writ.
