Opinion of the Court

In re: Tri-South Mortgage Investors applying for certiorari, or writ of review, to the Court of Appeal, First Circuit, Parish of Terrebonne, 349 So.2d 1321.

Writ granted. Judgment of court of appeal reversed. Ruling of trial judge is correct. See La.R.S. 12:491, et seq. as amended by Act 526 of 1977. Case remanded to court of appeal for further proceedings.

SUMMERS, J.

While I agree that the writ should be granted, I cannot agree that the in chambers decree issued by the court is proper without a hearing.
