State v. Bagley

State v. Bagley
Supreme Court of Louisiana · Decided November 11, 1977 · Sanders, Writ
352 So. 2d 232; 1977 La. LEXIS 5907 (Southern Reporter, Second Series)

State v. Bagley

Opinion of the Court

In re: David L. Bagley, applying for writs of certiorari, prohibition and mandamus.

Writ denied. Since relator cannot be sentenced to jail under La.R.S. 32:415, Argersinger v. Hamlin, 407 U.S. 25, 92 S.Ct. 2006, 32 L.Ed.2d 530 (1972) is not applicable here. Hence, ruling of trial judge is correct.

SANDERS, C. J., concurs in the denial of the writ.
