Sanders v. Hall

Opinion of the Court

In re: Robert Sanders, et al. applying for certiorari, or writ of review, to the Court of Appeal, Fourth Circuit, Parish of Orleans, 350 So.2d 262.

Denied.

Dissenting Opinion

TATE, J.,

dissents. Although the majority of this Court apparently feels that the court of appeal properly applied Coco, the court of appeal apparently reduced the awards based on its record — deduction of exaggeration. I see no sound reason for a reviewing court to reach this conclusion in opposition to the trior of fact, simply because similar injuries with similar medical treatment were received in the same accident.
