dissents. This applicant was properly represented by retained counsel and was tried before the judge who denied his application for a full transcript to serve as a basis for habeas relief — U.S. v. MacCollom, 426 U.S. 317, 96 S.Ct. 2086, 48 L.Ed.2d 666 (1976); Bonner v. Henderson, 517 F.2d 135 (5th Cir. 1975).
