In re: Kevin Dougherty applying for writs of mandamus and prohibition. Parish of East Baton Rouge.

Writ denied. Adequate remedy by appeal in the event of conviction.

Concurring Opinion

TATE, J.,

concurs. I agree with the Monroe Court that the affidavit seems to indicate staleness. However, the issue may be reviewed on appeal from a conviction either after trial or upon a plea of guilty.

DIXON and DENNIS, JJ., would grant the writ.
