Concurring Opinion

DIXON, CALOGERO, MARCUS and DENNIS, JJ.,

concur in the denial but note that it was error for the Court of Appeal to refuse to consider defendant’s objection to the jury charges, made by agreement after jury had retired. Such agreement does not conflict with CCP 1793. Nevertheless full review by Court of Appeal makes the error harmless.
