State v. Bazley
Supreme Court of Louisiana · Decided July 7, 1978 · Dennis, Tate
360 So. 2d 881; 1978 La. LEXIS 6356 (Southern Reporter, Second Series)

State v. Bazley

Opinion of the Court

In re: Michael Bazley applying for writs of certiorari, review, prohibition, mandamus and stay order. Parish of Orleans.

Writ granted. Since it does not appear that an evidentiary hearing has been held on defendant’s motion for reduction of bail, it is ordered that an evidentiary hearing be held.

Concurring Opinion

DENNIS and TATE, JJ.,

concur and are of the opinion that an evidentiary hearing should have been held on the State’s motion to increase bail in order to provide a basis for the finding of “good cause” to increase bail.
