TATE, J.,

dissents. Hornsby v. Department of Highways, 241 La. 989, 132 So.2d 871 (1961), was incorrectly decided and should be overruled. See Hebert v. T. L. James, 224 La. 498, 70 So.2d 102 (1954). See also Louisiana Constitution of 1974, Article 1, Section 4.
