Opinion of the Court

In re: Francis Theriot, applying for remedial writs. Parish of Cameron.

*1207Writ granted. The sentence heretofore imposed in this case is set aside and the case is remanded for resentencing in a manner consistent with law. See State v. Segers, 357 So.2d 1 (La. 1978); State v. Bosworth, No. 61,492, 360 So.2d 173 (La. 1978).

concurs in the granting of the Writ, being of the opinion that the case is controlled by State v. Bosworth, No. 61,492, La., 360 So.2d 173, handed down June 19, 1978, from which he dissented.
