Gills v. Our Lady of the Lake Hospital

Gills v. Our Lady of the Lake Hospital
Supreme Court of Louisiana · Decided September 1, 1978 · Dixon
361 So. 2d 1209; 1978 La. LEXIS 6287 (Southern Reporter, Second Series)

Gills v. Our Lady of the Lake Hospital

Opinion of the Court

In re: Dr. James A. Poche, applying for certiorari, or writ of review, to the Court of Appeal, First Circuit. Parish of East Baton Rouge.

Writ denied, with reservation: Our denial is without prejudice to the defendant to raise the issue by a formal dilatory exception pleading prematurity. See also Steeg v. Lawyers Title Ins. Co., 329 So.2d 719 (La. 1976).

Concurring Opinion

DIXON, J.

concurs only because this disposition might be more efficient than our granting a writ; the Court of Appeal was clearly in error in failing to rule on applicant’s contention.
