Dissenting Opinion

TATE, J.,

would grant the writ. In my opinion, the maintenance of the fire-prone premises makes the owner thereof liable to his neighbor for the damage resulting from the fire, more probably than not due to the' defective condition of the premises. La.C. C.Arts. 667, 2317.
