Cobbs v. Veith
Supreme Court of Louisiana · Decided September 1, 1978 · Dennis, Grant, Tate, Writ
362 So. 2d 777; 1978 La. LEXIS 6681 (Southern Reporter, Second Series)

Cobbs v. Veith

Opinion of the Court

In re: John Cobbs and Georgia Cobbs, applying for certiorari, or writ of review, to the Court of Appeal, Fourth Circuit. Parish of Orleans. 359 So.2d 303.

Writ denied.

DENNIS, J., would grant the writ.

Dissenting Opinion

TATE, J.,

would grant the writ. In my opinion, the maintenance of the fire-prone premises makes the owner thereof liable to his neighbor for the damage resulting from the fire, more probably than not due to the' defective condition of the premises. La.C. C.Arts. 667, 2317.
