Concurring Opinion

TATE, J.,

is of the opinion that upon the relator’s written request a preliminary default should be ordered, if no answer is filed, since service was made on the wife. La.C.Civ.P. Arts. 961, 1701. The relator is not, however, entitled to furlough from prison to testify.
