1978 La. LEXIS 6874
Application, Deny, Dixon, Summers

Hankel v. Hartford Fire Insurance

Opinion of the Court

In re: Michel J. Hankel, Jr., applying for certiorari, or writ of review to the Court of Appeal, First Circuit. Parish of St. Tammany.

Granted, and remanded to the Court of Appeal for its reconsideration in light of Ardoin v. Hartford Accident and Indem. Co., 360 So.2d 1331 (La. 1978) without limitation on the Court of Appeal’s consideration of any other issues advanced at the reargument.

SUMMERS, J., would deny the application.

Concurring Opinion

DIXON, J.,

concurs in the remand; in addition, the Court of Appeal might wish to dispose of the contended issue, if serious, that the injury was caused in part by the failure to extend the surgical procedures to another interspace.
