State ex rel. Bruard v. Blackburn

Opinion of the Court

In re: Calvin R. Bruard, applying for writs of habeas corpus, certiorari, prohibition and mandamus. Parish of Orleans.

Writ granted. The enhanced sentence is vacated and the case is remanded to the trial court for resentencing in the light of State v. Anderson, 349 So.2d 311 (La. 1977).

Concurring Opinion

SUMMERS, J.,

While I am of the opinion the writ should be granted, I would place the case on the docket and permit arguments, after which an opinion would be written.
