Wexler v. Martin

Supreme Court of Louisiana
Wexler v. Martin, 369 So. 2d 1352 (La. 1979)
1979 La. LEXIS 5795
Blanche, Calogero, Marcus

Wexler v. Martin

Opinion of the Court

In re Austin Martin, Kenneth Rearick, Clearview Wrecker Service & Allstate Insurance Co. applying for writ of certiorari, Fourth Circuit Court of Appeal. 367 So.2d 111, 369 So.2d 273. Parish of Jefferson.

Writ denied.

Dissenting Opinion

MARCUS, J.,

would grant the writ, believing the Court of Appeal opinion is incorrect and agreeing with dissent.

Concurring Opinion

CALOGERO and BLANCHE, JJ.,

concur in writ denial. Result here is probably correct. But since writ was denied in Watson v. Morrison, 340 So.2d 588 (La.App. 1st Cir. 1976), where there was a contrary result writ should be granted and issue clearly decided by that court.
