City of Shreveport v. Shaffer

City of Shreveport v. Shaffer
Supreme Court of Louisiana · Decided April 9, 1979
369 So. 2d 1353; 1979 La. LEXIS 6223 (Southern Reporter, Second Series)

City of Shreveport v. Shaffer

Opinion of the Court

In re Ernest W. Shaffer, Jr. applying for remedial writ. Caddo Parish. City Court of Shreveport. T-5319.

Writ denied. Unlike the case on which relator relies, City of New Orleans v. Lyons, 342 So.2d 196, the Shreveport ordinance under which relator was prosecuted is a “fighting words” breach of the peace statute. See Chaplinsky v. New Hampshire, 315 U.S. 568, 62 S.Ct. 766, 86 L.Ed. 1031 (1942) as reaffirmed in Gooding v. Wilson, 405 U.S. 518, 92 S.Ct. 1103, 31 L.Ed.2d 408.
