Opinion of the Court

In re Dr. Joseph M. Nadell and Dr. Donald Richardson, applying for supervisory or remedial writs. Orleans Parish. No. 77-1837; C/A No. 10245.

Writ granted. Our interpretation of the judgment of the district court is that it did overrule the plea of prematurity. Hence, case remanded to the court of appeal for it to examine its supervisory jurisdiction.

SUMMERS, C. J.,

would grant the writ and order the record sent to this Court for a hearing and opinion.

Dissenting Opinion

CALOGERO, J.,

dissents believing this Court should not exercise its supervisory jurisdiction. Court of Appeal’s denial, for the reasons expressed, would not adversely affect the rights of the parties, particularly as relates to a renewed filing of exceptions of prematurity.
