Miller v. Lake Forest, Inc.
Supreme Court of Louisiana · Decided June 25, 1979 · Dennis, Grant, Writ
372 So. 2d 1046; 1979 La. LEXIS 6688 (Southern Reporter, Second Series)

Miller v. Lake Forest, Inc.

Opinion of the Court

In re Timothy Todd Miller, applying for extension of time to file writs. 4th Circuit Court of Appeal. Orleans Parish. 370 So.2d 647.

Relief denied. The motion for extension of June 14th cannot be allowed to extend the statutory delay within which to apply for writs, and it cannot be considered as a writ application. Therefore, the pleading filed June 20th was untimely.

DENNIS, J., would grant the writ.
