Dissenting Opinion

TATE, J.,

would grant. No equitable defense justified the employer not to pay the workman his three hours overtime, and he is entitled to statutory wage penalties. The penalty statute was designed to penalize the unjustified underpayment of wages, however small in amount. Indeed, the smaller the amount, the greater the need for penalty.
