Succession of Heiss

Opinion of the Court

In re Succession of Martha U. Heiss applying for writs of certiorari, prohibition and mandamus. Parish of Jefferson. No. 215-054.

Writ granted. The trial court abused its discretion in staying the Louisiana proceeding without affording a hearing on the issue of the defendant’s domicile at the time of death.

SUMMERS, C. J., absent. DIXON, J., dissents. There is no showing in this application that the trial judge was wrong in applying C.C.P. 532.
