Turner v. Breaux
Turner v. Breaux
373 So. 2d 545; 1979 La. LEXIS 6837
(Southern Reporter, Second Series)
Turner v. Breaux
Opinion of the Court
In re Ernest Turner applying for supervisory writs. Parish of Lafourche. No. 29771.
Writ denied. The petitioner has already served the term of the sentence imposed as a result of the uncounseled guilty plea, so he is not entitled to relief under Argersinger v. Hamlin, 407 U.S. 25, 92 S.Ct. 2006, 32 L.Ed.2d 530 (1972). The trial court has indicated that it will not allow this conviction to be used as the basis for revocation of the petitioner’s probation.
