Concurring Opinion

TATE, CALOGERO and DENNIS, JJ.,

would grant the writ. The limitation of liability did not in terms exclude liability for the defendant’s breach of contract. The plaintiff is entitled to the return of the money paid for a worthless burglary alarm system.
