Theriot v. Mermentau Resources, Inc.
Supreme Court of Louisiana · Decided April 8, 1980 · Deny, Dixon, Watson, Writ
383 So. 2d 14; 1980 La. LEXIS 7257 (Southern Reporter, Second Series)

Theriot v. Mermentau Resources, Inc.

Opinion of the Court

In re Mermentau Resources, Inc. applying for writs of certiorari, prohibition, and mandamus, to the 38th Judicial District Court. Parish of Cameron. No. 7612.

*15Granted. The case is remanded to the Court of Appeal with instructions to rule on the merits of the application.

Concurring Opinion

DIXON, C. J.

concurs in the grant; the Court of Appeal is apparently confusing the standard of appeal from an interlocutory judgment. See C.C.P. Art. 2083. If there is irreparable injury, there is a right of appeal.

WATSON, J., would deny the writ.
