State v. James
Supreme Court of Louisiana · Decided December 11, 1980 · Watson
391 So. 2d 835; 1980 La. LEXIS 9451 (Southern Reporter, Second Series)

State v. James

Opinion of the Court

In Re: State of Louisiana through the District Attorney, Harry F. Connick applying for Supervisory Writs, Parish of Orleans, No. M-105-196. and M-105-269.

Writ granted in connection with that state application concerning Kevin James. Stay order continued in effect until further order of this Court.

Since no application has been filed by the state with respect to the juvenile Earl Pierre we take no action in that case except to vacate the stay order heretofore granted.

Dissenting Opinion

WATSON, J.,

dissents from the continuance of the stay order, being of the opinion that the juvenile has not been “charged” until indicted or a bill of information filed.
