United Pentecostal Church International, Inc. v. Sanderson

United Pentecostal Church International, Inc. v. Sanderson
Supreme Court of Louisiana · Decided February 6, 1981 · Dixon, Lemmon
395 So. 2d 682; 1981 La. LEXIS 6976 (Southern Reporter, Second Series)

United Pentecostal Church International, Inc. v. Sanderson

Opinion of the Court

In Re United Pentecostal Church International, Inc., et al. Applying for Certiora-ri, or Writ of Review, to the Court of Appeal, Second Circuit, Parish of Caddo, No. 14301, 391 So.2d 1293.

Denied. The result is correct.

Concurring Opinion

LEMMON, J.,

concurs. The petition which seeks injunctive relief, but does not allege breach of a contract between the parties or violation of Louisiana corporation law, does not state a cause of action.

Dissenting Opinion

DIXON, C. J.,

would grant and reverse the judgment on the exception to the jurisdiction; however, the result is probably correct, because an exception of no cause or no right of action probably should be sustained.
