Opinion of the Court

In re Court of Appeal, Fourth Circuit, applying for certified question. Orleans Parish. 395 So.2d 951.

Certification accepted. R.S. 18:1409(H) is not unconstitutional. There is no conflict with La.Const. Art. V, § 8 A, which provides that the Court of Appeal shall sit in panels “of at least three judges.” The legislature may provide for en banc decision on election cases. Case is remanded for action.
