DENNIS, Justice,

dissenting.

The trial judge was in the best position to assess what the majority describes as “a voluminous amount of largely conflicting evidence” received regarding whether the natural father was not entitled to custody because of neglect, abandonment and mental unfitness. I would uphold his ruling and reverse the court of appeal decision which awards custody to the natural father. Therefore, I respectfully dissent.
