401 So. 2d 1210; 1981 La. LEXIS 8617 (Southern Reporter, Second Series)

State v. Derryberry

Opinion of the Court

In re Larry Derryberry, applying for writ of review, and stay order. Parish of East Baton Rouge. No. 9-80-525.

Since relator’s sentence has been suspended and relator has been placed on probation, there is no necessity for a stay of execution of sentence pending consideration of the merits of relator’s application. The stay order is denied, but relator may apply for a stay of execution if the situation changes before disposition of the application.
