Denied; the ruling of the trial judge was correct.

MARCUS, J.

concurs in the denial as to Allstate; however, record does not reflect that trial judge ruled on Allstate’s motion to dismiss as to the Davises. See Murphy v. Hurdle Planning and Livestock, Inc., 331 So.2d 566 (La.App. 1st Cir. 1976), writ denied.
