Succession of LaCroix

Supreme Court of Louisiana
Succession of LaCroix, 407 So. 2d 1130 (La. 1981)
1981 La. LEXIS 10268
Lemmon

Succession of LaCroix

Opinion of the Court

Re: William M. Duett, Henry Guidry, Harry R. Cabral, Jr. and Arthur C. Reuter, applying for writs of Certiorari, or Review, to the Court of Appeal Fourth Circuit, Parish of Orleans, Number 12,415.

Granted. Judgment of the court of appeal, 400 So.2d 338, is reversed; case remanded to the court of appeal for determination on the merits.

Concurring Opinion

LEMMON, J.,

concurs. The judgment of the trial court, couched in terms of maintaining an exception of no cause of action, really decided the merits of the motion. Amendment under CCP Art. 934 is not appropriate following a judgment on the merits.

On remand, La.App., 408 So.2d 1170.
