Associated General Contractors of America, Inc. v. Bossier Parish Police Jury
Supreme Court of Louisiana · Decided March 3, 1982 · Blanche, Calogero
410 So. 2d 1127; 1982 La. LEXIS 10357 (Southern Reporter, Second Series)

Associated General Contractors of America, Inc. v. Bossier Parish Police Jury

Opinion of the Court

Re: The Associated General Contractors of America, Inc., Louisiana Highway, Heavy, Municipal & Utilities, Branch, and Grace Construction Co., applying for Supervisory Writs of Mandamus, Prohibition and Certiorari, Bossier Parish, No. 58,193.

Denied. We are unable to say that the courts below erred in denying relators the relief sought.

Dissenting Opinion

CALOGERO and BLANCHE, JJ.,

would grant the writ believing that the Public Bid Law prevents the parish from constructing the bridge in question when the cost exceeds the $30,000 limit provided for by LSA 38:2212 A(l). It is our further opinion that building a bridge to replace an old bridge is by its nature, a construction project and is not “maintaining ... public properties ...” so as to except the project from the Public Bid Law.
