Chevalier v. Guillotte

Opinion of the Court

Re: Allen P. Chevalier and Mark Siler, applying for writs of Certiorari or Review, *1322to the Court of Appeal, Third Circuit, Numbers 8583 & 8584.

Denied. The result is correct.

Concurring Opinion

DIXON, Chief Justice, and CALOGERO, Justice,

concurring.

The interpretation of “judicial confession” is in error. (See Comments to CCP 2085.) Plaintiff’s allegation of a defendant’s negligence is not a “judicial confession.” Wall v. Employer, La., 386 So.2d 79, was misunderstood. See Raley v. Carter, Supreme Court of Louisiana, 412 So.2d 1045 by Blanche, J. (1982).
