Schwegmann Giant Super Markets v. Louisiana Dairy Stabilization Board
Supreme Court of Louisiana
Schwegmann Giant Super Markets v. Louisiana Dairy Stabilization Board, 420 So. 2d 154 (La. 1982)
1982 La. LEXIS 12005
Calogero, Dennis, Dixon
Schwegmann Giant Super Markets v. Louisiana Dairy Stabilization Board
Opinion of the Court
In Re Louisiana Dairy Stabilization Board, Applying for Certiorari, or Writ of Review, to the Court of Appeal, First Circuit, No. 14,472, Parish of East Baton Rouge.
Writ denied.
Dissenting Opinion
would treat as an appeal because the statute was held unconstitutional.
Concurring Opinion
agrees that the case should be brought up to this Court. Even if the court of appeal did not declare the statute unconstitutional on its face, the applicant raises a serious issue by its contention that the record is devoid of evidence that the statute has been applied unconstitutionally.
