would treat as an appeal because the statute was held unconstitutional.

Concurring Opinion

DENNIS, J.,

agrees that the case should be brought up to this Court. Even if the court of appeal did not declare the statute unconstitutional on its face, the applicant raises a serious issue by its contention that the record is devoid of evidence that the statute has been applied unconstitutionally.
