City Court of Breaux Bridge v. Town of Breaux Bridge

Opinion of the Court

In Re: City Court of Breaux Bridge, applying for Supervisory Writ, Parish of St. Martin, 16th Judicial District Court, No. 36871; Third Circuit Court of Appeal, No. 82-831.

Denied.

Concurring Opinion

LEMMON, Justice,

concurs in denial.

The substantial issue of the constitutionality of La.R.S. 13:2488.76 is better presented by a litigant in an adversary proceeding.

DIXON, C.J., and WATSON, J., would grant the writ.

WATSON, J., notes that he believes the City Court may have the inherent authority to order the City to pay its necessary expenses.
