Concurring Opinion

CALOGERO, J.,

would grant the writ. Even however under the majority’s assessment that relator has not come here within 10 days of the court of appeal’s denial of writs, relator is still at liberty to seek time from the district court for filing application with this Court from the adverse district court ruling.
