Concurring Opinion

LEMMON, J.,

concurs. This decision simply holds that plaintiff did not prove present disability. Since relator was paid benefits for a period of time after the accident, he may be able to reassert the claim if his residual condition caused by this accident becomes disabling in the future.

DIXON, C.J., and CALOGERO and DENNIS, JJ., would grant the writ.
