Boudreaux v. Ultramar Enterprises, Inc.

Opinion of the Court

In Re: Mr. & Mrs. Earl Boudreaux, applying for Supervisory Writs and Stay Order, Court of Appeal, Fifth Circuit, No. 82-C-201; 24th Judicial District Court, Parish of Jefferson, No. 272-505.

Denied.

Concurring Opinion

LEMMON, J.,

concurs. While the trial court incorrectly quashed the deposition, relator has not shown why the depositions became necessary after a status conference during the one-month recess or how specific prejudice will occur unless the deposition is ordered.

CALOGERO, J., would grant a continuance and permit the taking of the deposition.
