Jefferson v. Morton Salt Co.
Supreme Court of Louisiana · Decided June 10, 1983 · Blanche, Deny, Lemmon, Writ
436 So. 2d 456; 1983 La. LEXIS 10856 (Southern Reporter, Second Series)

Jefferson v. Morton Salt Co.

Opinion of the Court

PER CURIAM.

The court of appeal is ordered to grant a rehearing in this matter and, after due consideration, to enter an appropriate order including possible remand to the trial court for the taking of additional evidence relative to plaintiffs surgery.

BLANCHE, J., would deny the writ.

Concurring Opinion

LEMMON, J.,

concurs. The only dispute was whether plaintiff had a residual disability from a work related injury. Since the new evidence was obtained before the judgment became definitive, plaintiff is entitled to a remand to the trial court for a hearing and decision, in the light of that evidence, on whether plaintiff is entitled to a new trial.
