English v. National Collegiate Athletic Ass'n

Supreme Court of Louisiana
English v. National Collegiate Athletic Ass'n, 438 So. 2d 209 (La. 1983)
1983 La. LEXIS 11599
Blanche, Dixon, Marcus, Watson

English v. National Collegiate Athletic Ass'n

Concurring Opinion

DIXON, J.,

concurs in the denial. The Court of Appeal acted promptly and correctly in the exercise of its supervisory jurisdiction.

Opinion of the Court

In Re: Jon English, applying for Supervisory Writs and/or Writ of Review, and Stay Order to the Court of Appeal, Fourth Circuit, No. C-1357; Civil District Court, Parish of Orleans, No. 83-14981.

Denied.

Dissenting Opinion

MARCUS and WATSON, JJ.,

would grant the writ, being of the opinion that the Court of Appeal erred in interfering with the conduct of the proceedings in the trial court.

Dissenting Opinion

BLANCHE, J.,

would further grant, believing that the trial judge acted within the discretion permitted by CCP Art. 3606 after the first continuance was agreed to by all parties.
