CALOGERO, J.,

would order that the evi-dentiary hearing requested by relator be held. If certain of the assertions contained in the affidavit of relator’s counsel can be proved, the defendant’s constitutional rights, to a fair trial and to reasonably effective assistance of counsel, have been violated, in instances which were not the subject of this Court’s review on appeal.
