In Re: Charles Brummett, applying for Writ of Certiorari and Stay Order, to the Thirty-Fifth Judicial District Court, Parish of Grant, Number 43849.

Granted. The sentence is set aside, and the case is remanded for resentencing in accordance with law. See La.C.Cr.P. Art. 880.

Concurring Opinion

DIXON, C.J.,

agrees with the ruling of this Court. In addition, it is noted that 5 months is an apparently severe sentence for *145the crime charged for a 26-year old man with an apparently good record, except for a problem with alcohol. Even so, what the relator did was serious, and the apparent consequences were disastrous.
