State ex rel. Lindsey v. Maggio
Supreme Court of Louisiana · Decided January 18, 1984 · Dennis
444 So. 2d 623; 1984 La. LEXIS 7994 (Southern Reporter, Second Series)

State ex rel. Lindsey v. Maggio

Opinion of the Court

In Re: TYRONE LINDSEY, applying for Writ of Review and Stay Order, to the Twenty-Fourth Judicial District Court, Parish of Jefferson, Number 80-220.

Denied.

Concurring Opinion

DENNIS, J.,

concurs in denying the petitioner’s application for stay of execution and for writs. Petitioner’s supplemental application fails to establish good cause to stay the execution for consideration of his Brady claim. The allegations of fact do not constitute grounds for a new trial because they fail to show the names of the witnesses who will testify and that they are not beyond process of the court or otherwise unavailable. C.Cr.P. article 854.
