DENNIS, J., joined by DIXON, C.J., and CALOGERO and LEMMON, JJ.,

concurs but is of the opinion that in a proper case this Court should re-examine the holding in State v. Davis, 411 So.2d 434 (La. 1982) relied on by the Court of Appeal.
