State v. Cage

Opinion of the Court

In Re: Donald Lee Cage, applying for Certiorari, or Writ of Review to the Court of Appeal, First Circuit, No. 83-KA-0828; 19th Judicial District Court, Parish of East Baton Rouge, No. 5-81-963.

Case below: 444 So.2d 347.

Denied.

Dissenting Opinion

DIXON, C.J.,

would grant because the “enhancement” contingency (14:95.2) was not charged in a count in the bill. The treatment of this issue in State v. Roussell, 424/226, should probably be overruled.

Reconsideration denied, 449 So.2d 1024.

CALOGERO, J., would grant the writ.
